Frank Morella's real estate firms ordered out over $400,000 debt
A court found Frank Morella's two real estate businesses owed more than $400,000 in unpaid rent.
Two businesses owned by Frank Morella failed to pay rent for Kingston offices. The companies were Canberra Commercial and Canberra Strata.
The building owner, Castelfelice Investments, also had Morella as a director. When Castelfelice defaulted on a St George Bank loan, receivers began selling the building.
They demanded vacant possession. The court found the two companies together owed more than $400,000 in unpaid rent.
Although no written lease existed, lease proposals from 2022 and the tenancy schedule showed a pattern of terms. Justice Angus Stewart ruled the lease terminations were reasonable.
He cited the long outstanding debt. He noted the difficulty of selling without written leases.
He cited the unlikely prospect of either company being able to pay. One company had already entered administration.
Canberra Strata later faced a winding-up order.
