Can my landlord kick me out in the ACT?
Only if the landlord has a listed reason. With no fault, notice is 8 to 26 weeks, with evidence.
Your clock
- 8 weeks: Moving in or sale
- 12 weeks: Renovation
- 2 weeks' notice, or 4 days in the last 2 weeks: You leave early
The rule in the ACT
- Periodic lease: moving in or sale, 8 weeks. Major renovation, 12 weeks. Other lawful use, 26 weeks.
- Unpaid rent: 1 week to pay, then 2 weeks' notice to vacate. Other breach: 2 weeks to fix, then 2 weeks.
- If you stay, the landlord must apply to ACAT. Only an ACAT order can remove you, then police with a warrant, usually with 2 days' notice.
ACAT can disallow a notice that is payback, if you apply before the notice period ends.
What to send
I received a notice to vacate dated [date]. Please send the written evidence.
