Can my landlord raise the rent in the ACT?
Yes, once every 12 months, with 8 weeks' notice. Above the cap needs your written OK or ACAT approval.
Your clock
- 8 weeks, written: Notice
- 12 months: Between rises
- 2+ weeks before it starts: Ask ACAT
The rule in the ACT
- Cap: your rise can be at most 1.1 times the percent rise in the Canberra rents index since your last rise.
- The notice must state the start day, amount, and whether above the cap.
- ACAT can review a rise. While it decides, the rent does not go up.
Older fixed terms may allow other rises if the lease says how.
What to send
I received your rent notice dated [date]. Please show it is within the cap.
