My landlord is selling in the ACT. Do I have to move?
Not without a valid notice. A sale does not end your lease. On a periodic lease, a landlord who genuinely intends to sell can give 8 weeks' notice with evidence.
Your clock
- 8 weeks: Sale notice
- 14 days: Your exit, fixed term
- 48 hours: Buyer visit
The rule in the ACT
- Periodic lease: a genuine intent to sell allows 8 weeks' notice, with written evidence.
- Buyers: 48 hours' notice, only if the landlord told you in writing they plan to sell. Up to 2 a week.
- Fixed term: leave on 14 days' notice, no fee, if an undisclosed sale offer comes within 6 months, or buyer inspections repeat after 8 weeks.
Evidence must come with the notice.
What to send
Please send written evidence of your plan to sell.
