Can my landlord kick me out in NSW?
Not without a valid reason. They must name a ground, for every lease type.
Your clock
- 90 days, not before a fixed term ends, 60 on terms up to 6 months: Most grounds
- 14 days: Unpaid rent or breach
- Apply to NCAT as soon as you can. The Tenants' Union gives 3 months from the end date: False ground
- 30 days from sale, repairs or move-in notice, 14 for others: Payback claim
The rule in NSW
- Notice is in writing with the ground, an information statement and any proof.
- Only a Sheriff's Officer with a warrant can remove you.
For money owed alone, you can stay if you pay it all, or agree a plan and keep to it, unless NCAT finds you have often paid late.
