Can my landlord raise the rent in NSW?
Yes, but only once every 12 months, never in the first 12 months, with 60 days' written notice.
Your clock
- 60 days or more, in writing: Notice they must give
- 12 months: Gap between rises
- 30 days from getting the notice: Challenge excessive rise at NCAT
The rule in NSW
- Covers month-to-month and fixed terms, except fixed terms under 2 years begun before 13 December 2024.
- Older terms rise only as the lease says.
- The notice must be in writing and state the new rent and the day it starts. Fair Trading also says it should be signed and dated.
A renewal with the same landlord does not restart the 12 months.
What to send
My notice is dated [date]. The last rise was [date], so I think it is invalid.
