Can my landlord kick me out in Queensland?
Not without a reason. Most need 2 months' notice. Only QCAT and a warrant can make you go.
Your clock
- 2 months, not before term end: Most grounds
- 7 days to pay, then 7 days' notice: Unpaid rent
- 14 days: Other breach
- 2 weeks after handover day: Landlord applies to QCAT
- 1 month from finding out: Payback notice: apply to QCAT
The rule in Queensland
- A Notice to leave (Form 12) must name the ground. A fixed term ending counts.
- To dispute the ground, go to the RTA first.
An end of term notice cannot be payback for a complaint.
What to send
Please send the proof for the ground in your Notice to leave dated [date].
