Can my landlord kick me out in SA?
No, not without a legal reason. Notice is usually 60 or 90 days, less for unpaid rent or breach.
Your clock
- 60 days: Possession reasons
- 90 days: Other listed reasons
- Give 7 days' written notice. Rent stops the day you hand the place back: Leaving early after a 60-day notice
The rule in SA
- Periodic lease: 60 days (Form 7) for demolition, major renovation, owner or close family moving in, or a sale. 90 days (Form 8) for other listed reasons.
- End of a fixed term: 60 days (Form 9), with a listed reason.
- Rent 14 days late: Form 5, 7 clear days to pay, or the tenancy ends. Other breach: 7 days to fix, then 7 to leave.
- Only SACAT can order you out.
SACAT can cancel a notice that is payback. If domestic abuse caused the breach, apply within 30 days of the notice.
