My landlord is selling in SA. Do I have to move?
Not without a valid notice. On a periodic lease, a sale contract or sales agency agreement allows 60 days' notice.
Your clock
- 60 days: Sale notice
- Give 7 days' written notice. Rent stops the day you hand the place back: Leaving early after that notice
- 7 days' notice, and your consent if your belongings show: Photos or video
The rule in SA
- Periodic lease: Form 7, 60 days, with written evidence.
- Fixed term: a sale reason can only end it at the end of the term, with 60 days (Form 9).
- They must tell you in writing they plan to sell, and name the buyer at least 14 days before settlement.
- Viewings: at a time agreed with you, up to twice in 7 days. You must not refuse unreasonably. If you cannot agree, SACAT can set a time.
A sale in the first 2 months that was not disclosed when you signed lets you end the lease (Form 13).
What to send
Please send the written evidence for the sale reason. I need 7 days' notice before photos.
