Can my landlord kick me out in Tasmania?
Only if the landlord has a reason in the Act. Notice is usually 14 or 42 days.
Your clock
- 14 days: Breach or rent
- 42 days: Sale, renovation, family, term ending
- 28 days after it took effect: Notice lapses
The rule in Tasmania
- Breach, rent or serious nuisance: 14 days. Fixing it in time cancels the notice. Paying all arrears cancels a rent notice, unless you had 2+ in 12 months.
- Periodic lease only: sale (with proof), other use, big renovation, family moving in: 42 days.
- A fixed term ending is itself a reason: at least 42 days, not before the end date.
- Only the Court can order you out.
The owner must show the reason was genuine or just.
What to send
