Can my landlord kick me out in WA?
Yes, if periodic: 60 days' notice, no reason needed. Only a court can make you leave.
Your clock
- 60 days: No-reason notice
- Ask the court within 7 days of getting the notice, up to 60 days more: More time
- 30 days' notice: Fixed term end
The rule in WA
- No reason: 60 days, not in a fixed term. Sale contract signed: 30 days.
- Breach: 7 days, after a notice to fix it 14 days earlier. Rent: paying it all before the date in the notice stops the court case.
- Retaking the place without a court order is an offence.
If a notice is payback for asking for repairs or complaining, you can ask the court to set it aside. The WA Government announced in May 2026 that it plans to end no-reason notices. No Bill has passed, so the rules above still apply today. Check Consumer Protection for updates.
