My landlord is selling in WA. Do I have to move?
Not without a valid notice. A sale alone does not end your lease. On a periodic lease, a signed sale needing the place empty allows 30 days' notice.
Your clock
- 30 days, periodic only: Sale notice
- 8am to 6pm weekdays, 9am to 5pm Saturday: Showing hours
- 30 days' notice: Fixed term end
The rule in WA
- A sale alone does not end a lease.
- After a sale contract needing empty possession, notice is 30 days, not in a fixed term. A knowingly false notice risks a $10,000 fine.
- Showings: reasonable written notice, reasonable number of times.
On a periodic lease the landlord can still use the 60-day no-reason notice instead.
What to send
Please confirm in writing whether a sale contract is signed. My lease continues until a valid notice ends it.
