Milhuisen claims another shooter killed O'Shea at Fawkner Park

Jason Milhuisen says a second gunman fired the fatal shots at career criminal Daniel O'Shea in 2019.

Former soldier Jason Milhuisen is appealing his 32-year murder sentence in the Victorian Court of Appeal. A jury said he shot career criminal Daniel O'Shea at Fawkner Park in South Yarra on April 26, 2019.

O'Shea was shot three times in the body and once to the head. Milhuisen's lawyer says the jury made a mistake.

DNA was found on the gun trigger. It does not match Milhuisen.

CCTV shows Milhuisen walking away calmly about seven minutes after the shooting. The defence says this proves he was not the shooter.

The defence says Milhuisen's role was to get rid of evidence, not to kill. Witness Z's testimony was key to the conviction.

The Crown says forensic evidence, including Milhuisen's DNA on the gun handle, proves he fired the shots.

Why it mattersA successful appeal could overturn one of Victoria's major underworld murder cases. It could also free a prisoner near the start of a long sentence.

AustraliaThe outcome will affect how Victorian courts weigh forensic evidence, witness reliability, and alternative theories in organised crime prosecutions.
