Brendan Nugent was arrested in 2022 after a confrontation with police in Wangaratta. Video shows the then 39-year-old holding a garden stake and telling officers they would have to shoot him.
Police used pepper spray and a taser. Nugent fell to the ground, was taken into custody and moved to hospital, then released without charges.
The incident followed a report of a man loitering outside a Wangaratta home. Nugent now faces three charges: dangerous driving causing serious injury, intentionally causing serious injury, and harming a Commonwealth official.
Helen Haines, 65, is in serious but stable condition at Melbourne's Alfred Hospital. She lost both legs.
