Man accused of fatal hit-run seeks bail in Supreme Court

Luton Murray, 38, faces Supreme Court bail application over charges including culpable driving causing death after allegedly hitting Shane Avery at 80kmh.

The Supreme Court of Victoria heard a bail application on October 20 for Luton Murray, 38, who is accused of hitting Ballarat man Shane Avery on August 16 while driving a green Ford Fiesta. Court CCTV footage showed Mr Avery exiting his son's car on Butt Street in Canadian.

Avery then walked toward the road centre before the Fiesta struck him at an estimated 80kmh. The impact flung him about 47 metres onto a grass verge.

Murray allegedly continued driving and fled the damaged car with a passenger. He handed himself to police about a week later.

Murray was charged with culpable driving causing death, dangerous driving causing death and driving while disqualified. The court heard he has a history of unlicensed driving offences.

The hearing was adjourned to October 28 because prosecution and defence could not agree on bail support services.
