Marty Busch Reserve assault: rape charge dropped, no prison time
Ian Bailey, 31, avoided prison after pleading guilty to sexual assault, receiving a 15-month community corrections order.
Ian Bailey was sentenced in the County Court of Victoria on October 15 for sexually assaulting a vulnerable woman at Marty Busch Reserve at 12.01am on January 28, 2025. Ian Bailey had repeatedly asked her for sex, which she refused.
The rape charge against him was withdrawn before trial. Judge Sarah Dawes noted Bailey had experienced trauma, bullying and an intellectual disability during childhood.
She concluded a community order would better protect the community than prison. The victim's mental health was severely affected.
She now avoids going out alone and struggles to trust people, her impact statement showed. Bailey must undergo drug assessment and a justice plan as part of his order.
Why it mattersThe sentencing shows how serious crimes can result in non-custodial sentences when judges weigh an offender's background, even when the victim's harm is severe.
AustraliaA Victorian court decision that raises questions about accountability in sexual assault cases and the protection of vulnerable victims in the state.
