Police admit photos in Luke Gosling bail case may show someone else

NT Police admitted photos used to caution MP Luke Gosling for breaching bail may show someone else, not him.

Northern Territory Police have agreed that photos may show someone else entirely. The photos were used to give Labor MP Luke Gosling a formal caution.

The caution was for breaching his bail conditions in September. The photos were supposed to show Gosling within 15 metres of NT Administrator David Connolly.

This was at a Cullen Bay cafe on 1 September. The man's face appears only in side profile.

It was roughly 3 centimetres tall when printed. Gosling's lawyers told police he was at school drop-off that morning.

They asked for CCTV evidence to prove it. A police detective wrote that Gosling may have a double in Darwin.

Gosling faces two assault charges over a Thai festival incident in July. He remains subject to strict bail conditions.

His legal team says the mistaken identity evidence would help test witness reliability at trial.

Why it mattersIf police gave out a caution based on wrong identification, it harms the prosecution's case. It also raises serious questions about how reliable witness identification is in the main assault charges.

AustraliaA sitting federal MP's court case carries national attention; weakening the prosecution's evidence strengthens his position ahead of this month's hearing.
