Woman loses discrimination case despite getting 4am interview notice
Female garbage truck driver's discrimination claim failed even though she was notified of her interview just hours before it happened.
A woman applying for a permanent role with Sydney's Inner West Council learned of her 10.30am interview at 4am, just as her shift was starting, while men applying for the same job received notice days earlier.
The woman had no time to prepare or change clothes. The tribunal acknowledged she had less notice than male candidates and that more advance warning gives an advantage.
The tribunal ruled there was no evidence that the short notice or her appearance affected her interview performance. The waste and recycling sector is about 95 per cent male.
The council said she was not among the strongest candidates, citing accidents on her record, though she scored third or fourth in the interview itself. The tribunal found no "smoking gun" showing the council treated her unfairly because of her sex.
