Judge spares Adelaide mother jail after car crash kills daughter
Mother failed to give way at an intersection, collision killed her six-year-old daughter; judge found jail sentence could not match suffering endured.
Zubeda Habonimana was driving her family to church in Virginia when she failed to give way and collided with a ute. Zubeda Habonimana's daughter suffered critical injuries and died five days later.
Habonimana was not speeding and was not affected by drugs or alcohol. Habonimana had missed a turn and become disoriented on an unfamiliar road.
In court, both her former partner and the ute driver urged the judge not to jail her. The ute driver, Jason Pateman, said the collision had deeply affected his own family.
But they did not want further suffering. The judge found that losing her daughter was already an immeasurable punishment.
Habonimana would not be jailed at formal sentencing in November.
