Hotel sacked manager just 11 days after miscarriage, ordered to pay €25,000
The Workplace Relations Commission ordered a Galway hotel to pay €25,000 after it sacked a manager.
Fadeside Ltd operates the Residence Hotel and 1520 Bar in Galway City. It sacked the manager in October 2023, saying it was for poor work.
The woman had been in hospital in September 2023 when she found out she was losing her baby. This was almost 11 months into her €60,000-a-year job.
The company's lawyer said maternity law did not apply because she was no longer pregnant. The Workplace Relations Commission rejected this view.
It ruled the sacking breached maternity rules. The tribunal found the company failed to show the serious reasons needed to fire a worker with maternity protections.
This is said to be the first time a worker has used maternity law to challenge a sacking after a miscarriage.
- €25,000
- Compensation ordered
- €60,000 per year
- Salary at time of miscarriage
- Almost 11 months when miscarriage occurred
- Employment length
Why it mattersThe ruling shows that maternity rights protect workers after a miscarriage. Protection is not just during pregnancy. This sets a new legal standard in Ireland.
AustraliaNo direct Australian effect yet, but the case may inform employment law discussions around maternity protections in Australia.
