Federal court overturns gold mine ban on procedural grounds
Federal Court found Plibersek's ban on the gold mine was unfair and sent it back to minister Watt.
Justice James Stellios ruled that the former environment minister's process for blocking the gold mine was flawed. Justice Stellios made no judgment on whether Indigenous heritage claims had merit.
The case involves concerns about a Dreaming story linked to the blue banded bee in Central West NSW. Mining company Regis Resources said finding a new site for approval would take up to 10 years.
NSW Premier Chris Minns welcomed the ruling, saying the mine must go ahead. It is vital for local jobs and state investment.
Current minister Murray Watt said he respects the court decision and is getting advice on next steps.
