Dylan Bell, 31, was sentenced to seven months in prison for illegal firearm possession. A Ballarat Magistrates' Court judge raised concerns about the prosecution's account of a January shooting at his Delacombe home.
The judge noted the incident matched another shooting where three men attended the house. One man was shot in the legs and torso.
The prosecution charged Bell with possession of a shotgun outside his Delacombe house when no one else was there. But Magistrate Mike Wardell found the reality was different.
The firearm was produced when intruders arrived and were shot. Bell's defence lawyer said he had successfully argued self-defence.
The prosecution chose not to challenge that claim in court. Wardell agreed the prosecution's version did not make sense.
Bell was not sentenced for the shooting itself.
